WAIVER AND RELEASE OF LIABILITY

Dynamometer
I, the undersigned, have requested that MCKEOWN MOTORSPORT ENGINEERING, INC. test and calibrate my vehicle on the
dynamometer.

A dynamometer, commonly referred to as a “dyno,” is a machine that is used to
measure the horsepower output of an engine. A chassis dynamometer has large rollers upon which
the drive wheels are placed. The vehicle is run up to a certain speed and put under load so the
amount of power that is being delivered to the wheels can be measured. The dynamometer may also
be used to simulate actual driving conditions when troubleshooting drivability problems.
I understand that dynamometers have an inherent amount of risk. Testing for maximum horsepower
places strain on a vehicle’s engine comparable to that of actual racetrack driving. I further
understand and agree that mechanical problems occasionally occur during or as a result of such
testing and calibration. These mechanical problems may include, but are not limited to, blown head
gaskets, thrown rods, and broken pistons.

Notwithstanding the inherent danger, I hereby authorize MCKEOWN MOTORSPORT ENGINEERING, INC to test and calibrate my
vehicle on the dynamometer. In consideration, I hereby knowingly and voluntarily release, waive,
discharge, and covenant not to sue
MCKEOWN MOTORSPORT ENGINEERING, INC, nor it’s directors, agents, or employees
(hereinafter referred to as “Releasees”) from any and all obligations, claims, or causes of action of
any kind whatsoever, known or unknown, in tort, contract, or by federal, state, or local statute,
regulation, or order, or on any other basis, for equitable relief, compensatory, punitive, or other
damages, or for expenses (including attorney’s fees) whether caused by the negligence of the
Releasees or otherwise, that arise in connection with the testing of my vehicle on the dynamometer.

Your vehicle must have at least 4” of ground clearance to go on the dyno.
On some exhaust setups (such as dumps and some muffler designs) it is not possible to install our
wideband O2 sensor in the exhaust tip, there is an additional $10 charge for installing the wideband
in place of a factory O2 sensor under the car.

There is no discount for opting to not have your A/F
measured during dyno runs.

There is an additional $5 charge to dyno vehicles with diesel engines.
I have read this Waiver and Release of Liability and agree to and accept all of its terms.
